Terms of Use
The short version
- Test builds are pre-release software, so expect bugs and back up your work.
- Please keep what you see in test builds to yourself until ShootFlow launches.
- You keep the copyright in your photos.
- Nothing here takes away your rights under the Australian Consumer Law.
1. Who we are and acceptance
These terms are between you and Operator legal name (ABN ABN), which runs ShootFlow ("we", "us").
By using the website, joining the mailing list or using the app, including test builds, you agree to these terms. If you don't agree, please don't use them.
2. The website
The light readings on the site are estimates calculated from the date and a location. They don't account for weather, terrain or buildings. Check the conditions yourself before you rely on them for a shoot.
3. The mailing list
You need to be 16 or older to join the mailing list. Joining it doesn't sign you up for anything else, and doesn't guarantee a TestFlight invite.
We may close the mailing list at any time. How we handle your details is set out in the privacy policy.
4. TestFlight beta
Test builds are pre-release software. They may crash, behave in unexpected ways or lose data, so back up anything you care about before you use them.
Each build runs for up to 90 days, then TestFlight asks you to update. We may stop offering test builds at any time.
If you send us feedback, you let us use it to improve ShootFlow, without owing you anything for it.
We ask one favour: please don't publish screenshots or reviews of test builds before ShootFlow launches.
Apple's TestFlight terms also apply to your use of TestFlight.
5. The app
The app is licensed to you under Apple's Standard EULA, unless we publish our own end user licence agreement for it. These terms add to that agreement.
6. Paid features, in future
ShootFlow is free to use, with a monthly allowance and Pro unlocking more. There are no paid features today: nothing has a price, and there's no in-app purchase.
If we add paid features later:
- they'll be sold only through Apple's In-App Purchase, at the price shown in the app;
- subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period;
- you can manage or cancel a subscription in Settings > your name > Subscriptions;
- refunds are handled by Apple;
- if we offer a free trial, its length and what you'll pay afterwards will be shown before you start, and any unused part of the trial ends when you buy a subscription.
7. Your content
You keep the copyright in your photos and anything else you make. Once community features exist, you give us a limited licence to host and display what you choose to share, only so ShootFlow can show it.
8. Acceptable use for community features
These rules apply once community features exist. We have zero tolerance for objectionable content and abusive users. Don't post or send:
- anything unlawful, infringing, harassing or hateful;
- any sexual content involving minors;
- anyone's private or identifying information (doxxing).
Don't share locations in ways that encourage trespass or put people, wildlife or sites at risk. Drone pilots must follow CASA's rules; ShootFlow doesn't give you permission to fly anywhere.
You'll be able to report content, block users and filter what you see. We'll act on reports within 24 hours, and may remove content or suspend accounts that break these rules (section 11).
9. Australian Consumer Law
Nothing in these terms excludes, restricts or changes any consumer guarantee, right or remedy you have under the Australian Consumer Law, or any other law, that can't lawfully be excluded.
10. Liability
Subject to section 9 (Australian Consumer Law), and to the extent the law allows, we aren't liable for any indirect or consequential loss arising from the website, the mailing list, test builds or the app, or for data lost while using a test build, which section 4 asks you to back up.
Where the law lets us limit our liability for a consumer guarantee, it's limited, at our choice, to supplying the service again or paying the cost of having it supplied again.
You're responsible for your own safety on location, and for any permits or permissions a shoot needs.
11. Suspension, termination and changes
We may suspend or end your access to the website, the mailing list, test builds or community features, for example if you break these terms.
We may change these terms. When we do, the version and the last-updated date at the top change with them, and the new terms apply from their effective date.
12. Governing law
These terms are governed by the law of Victoria, Australia, and you and we can bring any dispute to the courts there.
